# Panamanian citizenship through marriage

Marriage does not make you Panamanian on its own, but it shortens the wait. Under article 10, numeral 2, of the Constitution, a foreigner with a Panamanian spouse, or with children born in Panama to a Panamanian father or mother, can apply after three consecutive years of residency instead of five. Everything else stays the same: the renunciation, Spanish and the knowledge exam.

## Who qualifies for the three-year route

Article 10, numeral 2, covers two situations. The first is a spouse of Panamanian nationality. The second is having children born in Panama to a Panamanian father or mother. A child born in Panama to two foreign parents does not open this route: the child has to be the child of a Panamanian.

The wording of the numeral is dense, so we always read it with the constitutional text in front of us when we check a case.

## Three years counted from permanent residency

The three years are counted the same way as the five. Article 126 of Decree-Law 3 of 2008 says that continuous residency runs from the resolution that grants you permanent residency. Years spent on a provisional or temporary permit do not count toward the three.

## How you prove the family tie

Your petition includes your marriage certificate or the birth certificates of your Panamanian children. Article 120, numeral 5, of Decree-Law 3 of 2008 lists them among the documents of the file.

- Marriage certificate, if you apply as the spouse of a Panamanian.
- Birth certificates of your children, if you apply through them.
- Everything else on the official checklist: permanent residency card, criminal record certificates, proof of solvency and the tax clearance.

## What stays the same as the five-year route

The shorter wait is the only difference. You still declare your wish to naturalize, expressly renounce your nationality of origin, and prove Spanish and basic knowledge of Panama’s geography, history and political organization before the Electoral Tribunal. The same causes of refusal apply, and a refusal cannot be appealed.

## Questions people ask

### How long do I have to be married?

The Constitution and Decree-Law 3 of 2008 set no minimum length of marriage. What they require is the Panamanian spouse and three consecutive years of residency counted from your permanent residency.

### Can my Panamanian spouse sponsor me for citizenship directly?

No. You first need permanent residency in Panama, and then the three years. Naturalization is always your own petition.

### Does my child born in Panama make me eligible?

Only if the child’s father or mother is Panamanian. A child born in Panama is Panamanian by birth, but for this route article 10 asks for children born in Panama to a Panamanian parent.

## What the law does not say

- What happens if the marriage ends while the petition is in process. The law does not say.
- Whether a marriage celebrated abroad must first be registered in Panama for this route. We have asked and will update this page.
